Las Vegas Magistrate Orders DFS to Open Case Files

A federal magistrate in Las Vegas has granted NCYL’s request that Clark County child welfare officials turn over the case files of children who have been abused and neglected. The order issued March 12, 2008 by Magistrate Robert J. Johnston said that Clark County must provide the case files going back to 2004 of all children who have been the subject of an abuse or neglect report  while in the custody of the County. NCYL made the request in Clark K. v. Willden, a lawsuit to reform the County’s child welfare system.  

NCYL Senior Attorney <personname w:st="on">Bill Grimm</personname>, lead counsel on the case, could not say how many files are involved but estimates that there are well over 1,000.  

On March 26, 2008, County defendants filed an appeal of the Magistrate’s order. No decision has been issued on the appeal.
