ISSUES
This action was brought on behalf of over 200 individual abused and neglected children under the guardianship of the Illinois Department of Children & Family Services (DCFS), all of whom have experienced, are experiencing, or will experience multiple placement disruptions because of failed DCFS policies. Plaintiffs have suffered through at least 2,147 separate moves or approximately 7.4 moves per child. Plaintiffs requested injunctive and declaratory relief to order DCFS and DCFS's guardianship administrator to meet their statutory and constitutional obligations under the Illinois Constitution and statutes.
HISTORY AND STATUS
The complaint was filed on April 16, 2003, in juvenile court. The court heard defendants' motions to dismiss on July 9, 2003. Though the case was dismissed, the court granted plaintiffs leave to file an amended complaint. Plaintiffs filed an amended complaint on September 10, 2003, which the court again dismissed. Plaintiffs' counsel has filed individual lawsuits to address the issues raised by the case, and has generally been successful in getting the requested relief.
